Is CBD Legal in Georgia?
Yes. Hemp-derived CBD with 0.3% THC or less is legal in Georgia for adults 21 and over, as long as it's sold by a business licensed by the Georgia Department of Agriculture. CBD oil, softgels, topicals, gummies and non-alcoholic beverages are all allowed.
What Changed: Georgia's Hemp Law Timeline
May 10, 2019: Georgia legalizes hemp. Governor Brian Kemp signed the Georgia Hemp Farming Act (HB 213), which made hemp and hemp-derived CBD legal in the state.
April 30, 2024: SB 494 becomes law. Governor Kemp signed SB 494, which added new rules for consumable hemp products, including CBD.
October 1, 2024: The new rules take full effect.

Licensed sellers only. Stores, wholesalers and online sellers need a license from the Georgia Department of Agriculture.

21 and over. Selling consumable hemp products to anyone under 21 is prohibited.

State-registered lab testing. Products must be tested by a lab registered with the Department of Agriculture.

THC warnings. Products that contain THC need a state-approved warning sticker and access to their lab results.

Limits on hemp foods. Hemp-infused foods are banned, except gummies and non-alcoholic beverages.

No raw hemp flower. Selling raw hemp flower and leaves is prohibited.
2026 and beyond: Federal changes are coming. Congress has also passed a new federal definition of hemp that counts total THC and limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
