THC limits. Hemp products you swallow can't have more than 1 mg of total THC per serving or 10 mg per package. Tinctures can have up to 100 mg per package.

21+ for some products. Hemp flower, vapes and other concentrates, and products with more than 0.5 mg of THC per serving, can only be sold to adults 21 and over.

No delta-8 or synthetics. Delta-8, delta-10 and other synthetic cannabinoids are banned in hemp products, along with hemp pre-rolls and products mixed with alcohol or nicotine.

Licensed sellers and lab reports. Stores and websites selling hemp CBD to New Yorkers need a cannabinoid hemp retailer license, and every product needs a QR code that links to its lab report.
What Changed: New York's Hemp Law Timeline
December 2019: Cannabinoid hemp law. New York created its cannabinoid hemp program to license CBD processors and retailers.
March 31, 2021: MRTA. The Marijuana Regulation and Taxation Act legalized adult-use cannabis and moved hemp oversight to the Office of Cannabis Management (OCM).
December 13, 2023: OCM hemp rules. New THC limits of 1 mg per serving and 10 mg per package took effect, along with a ban on synthetic cannabinoids like delta-8. QR-code labeling followed on January 1, 2024.
December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
