CBD Oil in Colorado: 2026 Laws and How to Buy Lab-Tested CBD
CBD is legal in Colorado, and you can have it shipped to your door. Colorado has some of the strictest THC limits for hemp products in the country: since SB 23-271 in 2023, hemp products sold here can have no more than 1.75 mg of THC per serving. THC-free CBD isn't affected by those limits. This page explains the rules and how to get GoGreen Hemp's lab-tested, THC-free CBD delivered anywhere in Colorado.
Is CBD Legal in Colorado?
Yes. Hemp-derived CBD is legal in Colorado, and the Colorado Department of Public Health and Environment (CDPHE) regulates hemp products sold to consumers. Under SB 23-271:
-
THC limits. Hemp products can have no more than 1.75 mg of THC per serving and must have at least 15 times more CBD than THC.
-
Age limits. Products with more than 1.25 mg of THC per serving, or less than 20 times more CBD than THC, are for adults 21 and over. THC-free products, tinctures and cosmetics are exempt from that age limit.
-
Registered businesses. Companies that make or sell hemp products must be registered with CDPHE, and hemp ingredients must come from an approved source.
-
No intoxicating hemp. Higher-THC and converted products, like delta-8, can only be sold through Colorado's licensed marijuana system.
What Changed: Colorado's Hemp Law Timeline
November 6, 2012: Amendment 64. Colorado voters approved Amendment 64, which legalized adult-use marijuana and industrial hemp.
June 7, 2023: SB 23-271. Governor Jared Polis signed SB 23-271, which set THC-per-serving limits and CBD-to-THC ratios for hemp products and moved intoxicating hemp into the licensed marijuana system.
April 28, 2026: SB 26-164 fails. A bill to allow 5–10 mg THC hemp drinks in stores that sell alcohol died in committee, so Colorado's strict limits stay in place.
December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
