These Terms & Conditions ("Terms") govern your use of www.gogreenhemp.com (the "Site") and any purchase you make from GoGreen Hemp ("GoGreen Hemp," "we," "us," or "our"). By using the Site, creating an account, or placing an order, you agree to these Terms, our Privacy Policy, and our Store Policies. If you do not agree, please do not use the Site.

IMPORTANT: SECTION 17 CONTAINS AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. UNLESS YOU OPT OUT AS DESCRIBED IN SECTION 17, YOU AND GOGREEN HEMP AGREE TO RESOLVE DISPUTES THROUGH INDIVIDUAL BINDING ARBITRATION RATHER THAN IN COURT OR BY JURY TRIAL.

1. Agreement to These Terms

These Terms apply to everyone who visits or uses the Site, including browsers, customers, account holders, and program members. Some features — such as wholesale accounts, private label orders, our rewards and referral programs, or the Helping Hand Assistance Program — may have additional terms ("Supplemental Terms") that we show you when you sign up. If Supplemental Terms conflict with these Terms, the Supplemental Terms control for that feature.

2. Eligibility and Age

The Site is intended for adults. You must be at least 18 years old to use the Site, and you must meet the minimum age to purchase hemp and CBD products in the state where you live or where your order will be delivered, whichever is higher. By placing an order, you confirm that you meet these requirements and that you can form a binding contract.

We may ask for proof of age, and we may cancel any order if we believe it does not meet these requirements. If you are placing an order on behalf of a business, you confirm that you have authority to bind that business to these Terms.

3. Our Products and Hemp Compliance

Our products are made from hemp as defined by U.S. federal law. Most of our products are broad spectrum and test at 0.0% THC (non-detectable). Our full spectrum products contain trace amounts of THC below the federal limit for hemp. The THC and cannabinoid content of every batch is published on our Lab Results page

Hemp and CBD laws vary by state and are changing at the federal level. It is your responsibility to know and follow the laws where you live and where your order is delivered. We may limit, refuse, or cancel orders to any location where we believe a product cannot lawfully be sold or shipped, and we may discontinue or reformulate products to comply with changing laws. If we cancel an order for this reason, we will refund any amount charged for the canceled items.

Product descriptions, images, and specifications are provided as accurately as we can, but colors, packaging, and label designs may vary, and we may correct errors at any time. Always read the product label before use. Our products are for personal use and may not be resold without an approved wholesale or private label agreement.

4. Orders, Pricing, and Payment

All orders are subject to our acceptance and to product availability. We may limit quantities, refuse or cancel any order (including after you receive an order confirmation), and limit sales by person, household, or location. If an item is listed at an incorrect price due to an error, we may cancel the order and refund you, or contact you before shipping.

Prices are listed in U.S. dollars and may change at any time. Applicable sales taxes and any shipping charges are shown at checkout. We accept Visa, Mastercard, American Express, and Discover. Payments are processed by our third-party payment processor, Bankful, and you authorize us and our processor to charge your payment method for the full amount of your order. Charges will appear on your statement as "GoGreen Hemp" or a similar descriptor. If a payment is declined or reversed, we may cancel your order.

5. Subscribe & Save (Automatic Renewal)

Some products are offered through Subscribe & Save. By choosing Subscribe & Save at checkout, you agree that:

- Your subscription renews automatically. We will ship your product and charge your saved payment method on the schedule you select (for example, every month) until you cancel.

- Your price. Each renewal is charged at the Subscribe & Save price shown at checkout (currently 30% off the one-time price), plus any applicable tax and shipping. If the price changes, we will notify you by email before the change applies to your next renewal.

- How to cancel. You can cancel at any time from your account page on the Site or by emailing support@gogreenhemp.com. To avoid being charged for your next shipment, cancel before your next billing date. Cancellation stops future orders; it does not refund orders already processed, but those orders remain covered by our 30-Day Guarantee.

- Updates. You can change your product, quantity, or delivery schedule, or skip a shipment, from your account page or by contacting us.

- Payment problems. If a renewal payment fails, we may retry the charge or pause your subscription until your payment information is updated.

We will send an order confirmation that includes these terms and how to cancel.

6. Health Information

Statements on this Site and on our products have not been evaluated by the Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease.

Information on the Site, including our blog, guides, and FAQs, is for general educational purposes only. It is not medical advice and is not a substitute for advice from a doctor or other qualified health professional. Talk to your doctor before using our products if you are pregnant or nursing, take medication, or have a medical condition. Stop use and consult a doctor if you experience an adverse reaction. Keep all products out of reach of children and pets (except pet products used as directed).

7. Shipping, Returns, and the 30-Day Guarantee

Shipping times, lost or damaged packages, address errors, returns, and our 30-Day Guarantee are covered in our Store Policies, which are part of these Terms. Title and risk of loss pass to you when we deliver your order to the carrier.

8. Promotions, Rewards, Referrals, and the Helping Hand Program

Promo codes, rewards points, referral credits, and Helping Hand discounts:

- have no cash value and cannot be sold, transferred, or exchanged for cash;
- cannot be combined with other codes or discounts unless we say otherwise;
- may be subject to additional rules, eligibility requirements, and expiration dates shown on the related program page; and
- may be changed, suspended, or ended by us at any time, to the extent permitted by law.

We may cancel discounts, points, or credits obtained through fraud, abuse, duplicate accounts, self-referrals, or violations of program rules. Helping Hand Program discounts are for the approved member and their immediate family only, and documents submitted to the program are used only to verify eligibility, as described in our Privacy Policy.

9. Your Account

You may need an account to use some features, such as Subscribe & Save or rewards. You agree to provide accurate information, keep it up to date, and keep your password confidential. You are responsible for all activity under your account. Tell us right away at support@gogreenhemp.com if you believe your account has been used without your permission. We may suspend or close accounts that violate these Terms or that we reasonably believe are fraudulent.

10. Using the Site

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site for your own non-commercial purposes, subject to these Terms. You agree not to:

- use the Site in violation of any law, or buy products for resale without an approved wholesale or private label agreement;
- copy, scrape, or harvest content or data from the Site using bots, spiders, or other automated tools (other than standard search engine indexing);
- interfere with the Site's security or operation, introduce viruses or malicious code, or try to access accounts or systems without authorization;
- impersonate any person, misrepresent your affiliation with anyone, or provide false information (including false age or eligibility information); or
- use our name, logos, or trademarks in a way that suggests we endorse or are affiliated with you without our written permission.

You may link to the Site's home page or product pages, as long as you do not suggest an endorsement we have not given or display our content within a frame on another site.

11. Intellectual Property

The Site and its content — including text, product descriptions, graphics, logos, photos, videos, lab result pages, and software — are owned by GoGreen Hemp or our licensors and protected by U.S. and international intellectual property laws. "GoGreen Hemp," the GoGreen Hemp logo, and our product names are our trademarks. You may not copy, reproduce, modify, distribute, or create derivative works from our content without our written permission, except that you may print or save pages for your own personal, non-commercial use.

12. Reviews and Submissions

If you post a review, comment, photo, or other content, or send us feedback or ideas ("Submissions"), you confirm that the Submission is your own, is truthful, and does not violate anyone's rights or any law. You grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, display, edit for length or clarity, and distribute your Submissions in connection with our business, including in marketing, without payment to you. We will not use your name or likeness with a Submission beyond what you post publicly unless you agree.

You may not post content that is false or misleading, unlawful, harassing, hateful, obscene, infringing, or promotional, or that contains personal information about others. We may moderate, decline, or remove Submissions that violate these Terms. Reviews should describe your own experience with a product and should not claim that a product treats, cures, or prevents any disease.

13. Third-Party Links and Services

The Site may link to or rely on third-party websites and services, such as payment processors, shipping carriers, review platforms, and our product quiz. We don't control and aren't responsible for third-party sites or services, and your use of them is subject to their own terms and privacy policies.

14. Copyright Complaints

If you believe content on the Site infringes your copyright, send a notice to our designated agent that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and its location on the Site (such as the URL); (4) your name, address, telephone number, and email address; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

15. Disclaimer of Warranties

EXCEPT FOR OUR 30-DAY GUARANTEE AND ANY WARRANTY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, THE SITE, ITS CONTENT, AND OUR PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES, OR THAT ANY PRODUCT WILL PRODUCE ANY PARTICULAR RESULT FOR YOU. INDIVIDUAL RESULTS VARY.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GOGREEN HEMP AND ITS OWNERS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR OUR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR OUR PRODUCTS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM, OR (B) $100.

These limits do not apply to liability for death or personal injury caused by our negligence, for fraud, or to any other liability that cannot be limited under applicable law. Some states do not allow certain limitations, so some of them may not apply to you.

17. Dispute Resolution and Arbitration

Try to resolve it with us first. Most concerns can be resolved quickly. Before starting any formal proceeding, contact us at support@gogreenhemp.com with your name, order number (if any), and a description of the issue and the relief you want. We both agree to try in good faith to resolve the dispute informally for at least 30 days.

Mediation, then binding arbitration. If we can't resolve the dispute informally, either of us may request mediation through JAMS in Boca Raton, Florida (or its successor). If the dispute is not resolved within 45 days after the mediation request, either party may begin final and binding arbitration before a single arbitrator administered by JAMS under its Comprehensive Arbitration Rules & Procedures and, for consumer disputes, the JAMS Consumer Arbitration Minimum Standards. Arbitration fees will be allocated as those rules and standards require. Hearings will take place in Boca Raton, Florida, or, at your request, by video or phone or in the county where you live. The arbitrator may award the same individual relief a court could award. Judgment on the award may be entered in any court with jurisdiction.

Individual claims only. YOU AND GOGREEN HEMP AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL.

Exceptions. Either party may (a) bring an individual claim in small claims court if it qualifies, and (b) ask a court for an injunction to protect intellectual property rights or to stop unauthorized use of the Site.

Your right to opt out. You may opt out of this arbitration agreement within 30 days after you first accept these Terms by emailing support@gogreenhemp.com with the subject line "Arbitration Opt-Out," or by mail to the address in Section 22. Include your name, email address, and mailing address, and a clear statement that you are opting out. Opting out does not affect any other part of these Terms.

Time limit. To the extent permitted by law, any claim must be brought within two (2) years after it arose.

Courts. For any dispute not subject to arbitration, including if you opt out, you and we agree to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida.

18. Indemnification

You agree to defend, indemnify, and hold harmless GoGreen Hemp and its owners, employees, agents, and affiliates from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or applicable law, your Submissions, or your resale or misuse of our products.

19. Electronic Communications

By using the Site or contacting us, you agree to receive communications from us electronically, including order confirmations, subscription notices, and account messages, and you agree that these communications satisfy any legal requirement to be in writing.

If you sign up for marketing emails, you can unsubscribe at any time using the link in any email. We do not send marketing text messages.

20. Governing Law and General Terms

These Terms are governed by the laws of the State of Florida and applicable federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules. The Site is intended for users in the United States.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, carrier delays, supply shortages, or changes in law. These Terms, together with our Privacy Policy, Store Policies, and any Supplemental Terms, are the entire agreement between you and us about the Site and your purchases.

21. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the "Last Updated" date above. If we make material changes, we will notify account holders and active subscribers by email or by a notice on the Site before the changes take effect. Changes apply to orders placed after the updated Terms are posted; your continued use of the Site after that means you accept them. Changes to Section 17 will not apply to disputes that arose before the change was posted.
