CBD Oil in Illinois: 2026 Laws and How to Buy Lab-Tested CBD
CBD is legal in Illinois, and the state's hemp rules are changing this year. A new law signed on June 12, 2026, moves delta-8 and other intoxicating hemp products under cannabis rules, and new limits for all hemp products start November 12, 2026. Non-intoxicating CBD is still allowed. This page explains what's changing and how to get GoGreen Hemp's THC-free CBD delivered anywhere in Illinois.
Is CBD Legal in Illinois?
Yes. Non-intoxicating, hemp-derived CBD is legal in Illinois. Starting November 12, 2026, a finished hemp product can contain no more than 0.4 mg of THC per container. Products over that limit, including delta-8, are treated as cannabis and can only be sold under cannabis rules to adults 21 and over.
What Changed: Illinois's Hemp Law Timeline
August 2018: Illinois legalizes hemp. Governor Bruce Rauner signed SB 2298, the Industrial Hemp Act, which made hemp legal to grow and process in Illinois.
June 12, 2026: SB 3222 becomes law. Governor JB Pritzker signed SB 3222 (Public Act 104-463), which rewrote the state's hemp rules. Some changes took effect the same day:
-
21+ for intoxicating hemp. Delta-8, THC-P, HHC and other intoxicating hemp products can't be sold to anyone under 21.
-
ID checks. Sellers must check ID for anyone who appears to be under 30.
November 12, 2026: The new hemp rules take full effect.
-
0.4 mg THC limit. Finished hemp products can contain no more than 0.4 mg of THC per container. Anything over that is regulated as cannabis.
-
QR-code lab reports. Products need third-party lab testing, with the certificate of analysis linked from a QR code on the label.
-
Labeling rules. Labels must list ingredients, cannabinoid amounts, batch number and expiration date, and can't make health claims or appeal to children.
-
Manufacturer licenses. Hemp product manufacturers need a license from the Illinois Department of Agriculture.
December 11, 2026: Federal changes follow. Congress has passed a matching federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
