CBD Oil in Texas: 2026 Laws and How to Buy Lab-Tested CBD
CBD is legal in Texas, but the rules changed a lot in 2026. Since March 31, you must be 21 or older to buy any consumable hemp product, including CBD, and since July 31, converted cannabinoids like delta-8 are illegal again. Hemp-derived CBD with 0.3% THC or less is still legal and can be shipped to Texas. This page explains the rules and how to get GoGreen Hemp's lab-tested, THC-free CBD delivered anywhere in Texas.
Is CBD Legal in Texas?
Yes, for adults 21 and over. Hemp-derived CBD with 0.3% delta-9 THC or less is legal in Texas under the state's consumable hemp program, run by the Texas Department of State Health Services (DSHS). In 2026:
-
21 and over. Sellers must check a government-issued ID before every consumable hemp sale.
-
Registered sellers. Every retailer selling consumable hemp in Texas, including online retailers based out of state, needs a DSHS retail hemp registration.
-
No delta-8. Delta-8, delta-10, THC-O, HHC and other converted or synthetic cannabinoids are Schedule I controlled substances.
-
Tested and labeled. Products need lab testing, batch-level certificates of analysis and labels that meet state rules.
What Changed: Texas Hemp Law Timeline
June 10, 2019: HB 1325. Governor Greg Abbott signed the law that legalized hemp and consumable hemp products, including CBD, in Texas.
2025: A THC ban is vetoed. The Legislature passed SB 3, which would have banned most hemp THC products. Governor Abbott vetoed it in June 2025, and on September 10, 2025, he issued Executive Order GA-56, directing state agencies to ban sales to minors and tighten testing and labeling.
March 31, 2026: New DSHS rules. The state's new consumable hemp rules took effect, with a 21+ age limit, ID checks, testing and labeling standards, and higher fees. TABC rules for businesses with liquor licenses had already set a 21+ limit in January.
July 31, 2026: Delta-8 is illegal again. After a May 2026 Texas Supreme Court ruling, DSHS restored its listing of converted cannabinoids like delta-8 as Schedule I controlled substances. Natural, hemp-derived CBD isn't affected.
December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
