CBD Oil in Maine: 2026 Laws and How to Buy Lab-Tested CBD
CBD is legal in Maine, and Maine was one of the first states to allow hemp CBD in food. In 2025, the state added new rules for delta-8 and other intoxicating hemp products, but non-intoxicating CBD is still allowed. This page explains the rules, how they changed, and how to get GoGreen Hemp's THC-free CBD delivered anywhere in Maine.
Is CBD Legal in Maine?
Yes. Hemp-derived CBD with less than 0.3% THC is legal in Maine. Maine law lists CBD, CBG, CBN, CBC, THCV and CBDV as non-intoxicating cannabinoids. Intoxicating hemp products, such as delta-8, are legal only for adults 21 and over.
What Changed: Maine's Hemp Law Timeline
March 27, 2019: CBD allowed in food. Governor Janet Mills signed a law that treats hemp-derived CBD as a food ingredient, so CBD foods and drinks could stay on Maine shelves. The rules that came with it:
-
Clear labels. CBD products must list CBD and its amount by weight, plus the maker's name and address.
-
Under 0.3% THC. Hemp and CBD products must contain less than 0.3% THC.
-
No health claims. Labels and ads can't claim CBD diagnoses, treats, cures or prevents any disease.
June 2025: LD 1920 takes effect. Maine passed LD 1920 (Public Law 2025, chapter 416) as an emergency law:
-
Two kinds of cannabinoids. The law separates non-intoxicating cannabinoids like CBD from potentially intoxicating ones like delta-8.
-
21+ for intoxicating hemp. Potentially intoxicating hemp products can't be sold to anyone under 21.
-
Safer packaging. Intoxicating hemp products need child-resistant packaging and can't copy well-known brands.
December 11, 2026: Federal changes are coming. Congress has also passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
