CBD Oil in Massachusetts: 2026 Laws and How to Buy Lab-Tested CBD

CBD is legal in Massachusetts, but the state is stricter than most about what form it comes in. Hemp-derived CBD oils and topicals are allowed, while CBD foods, drinks and dietary supplements are not. In April 2026, Massachusetts also ordered a state study of intoxicating hemp products. This page explains the rules and how to get GoGreen Hemp's THC-free CBD oil and topicals shipped anywhere in Massachusetts.

Is CBD Legal in Massachusetts?

Yes. Hemp-derived CBD with 0.3% THC or less is legal in Massachusetts, and you don't need a medical marijuana card to buy it. The state limits which CBD products can be sold:

  • Allowed: CBD oil tinctures and topicals, like balms, roll-ons and massage oil.

  • Not allowed: food or drinks with added CBD, CBD sold as a dietary supplement, CBD in animal feed, and any CBD product that makes health claims.

What Changed: Massachusetts Hemp Law Timeline

June 2019: The state hemp policy. The Massachusetts Department of Agricultural Resources (MDAR) issued a policy listing the hemp products that can't be sold in the state: CBD foods, CBD dietary supplements, hemp in animal feed, and CBD products with health claims.

May 30, 2024: Food and drink advisory. State health and agriculture officials reaffirmed that CBD and THC can't be added to food or beverages made or sold in Massachusetts.

April 19, 2026: H.5350 becomes law. Governor Maura Healey signed a cannabis reform law that restructured the Cannabis Control Commission and directed it to study and recommend rules for intoxicating hemp products. Non-intoxicating CBD rules didn't change.

December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
