No synthetic cannabinoids. HB 49 tightened Montana's ban on synthetic cannabinoids, including converted products like delta-8, and barred them from licensed marijuana stores.

THC products belong in dispensaries. Marijuana is legal for adults 21 and over in Montana, but THC products are sold only by licensed dispensaries.

What Changed: Montana's Hemp Law Timeline
November 2020: I-190. Montana voters legalized marijuana for adults 21 and over, with sales through licensed dispensaries.
April 7, 2025: HB 49. Montana updated its synthetic cannabinoid law, expanding enforcement and banning synthetic cannabinoids from dispensaries.
May 2025: SB 375. Montana banned selling hemp products that contain THC to consumers unless the FDA has approved them. The law took effect as soon as it was signed.
December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container.
