• Medical marijuana is separate. Pennsylvania's medical marijuana program, created in 2016, is for registered patients. Adult-use marijuana isn't legal.

• CBD itself isn't restricted. Non-intoxicating CBD products can be sold in stores and shipped to your home.

What Changed: Pennsylvania's Hemp Law Timeline

2016: Act 92. Pennsylvania started its industrial hemp research program, which later became its hemp farming program.

March 16, 2026: SB 49 advances. A Senate committee voted 10–1 to advance a bill that would create a Cannabis Control Board and align Pennsylvania's hemp rules with the federal limits. It hasn't passed the full legislature.

September 2026: 21+ hemp proposal. State Senator Dawn Keefer announced the Pennsylvania Hemp and Cannabinoid Act, which would make hemp products 21+ and require sellers to register with the Department of Agriculture. It hasn't been formally introduced yet.

December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container.
