CBD Oil in West Virginia: 2026 Laws and How to Buy Lab-Tested CBD
CBD is legal in West Virginia, and you can have it shipped to your door. Since 2023, hemp products with THC-type cannabinoids, such as delta-8 and delta-9, have needed a state permit and can only be sold to adults 21 and over. A broader 2026 hemp bill didn't pass. Non-intoxicating, hemp-derived CBD is still legal. This page explains the rules and how to get GoGreen Hemp's THC-free CBD delivered anywhere in West Virginia.
Is CBD Legal in West Virginia?
Yes. Hemp-derived CBD with 0.3% delta-9 THC or less is legal in West Virginia, and you don't need a medical cannabis card to buy it. A few rules to know:
-
Hemp THC products are 21+. Products containing hemp-derived delta-8, delta-9, delta-10, HHC, THCP or THCV can only be sold to adults 21 and over, and websites must check age.
-
Sellers need a permit. Anyone making, distributing or selling those THC-type hemp products in West Virginia needs a permit from the Commissioner of Agriculture, and sales carry an 11% tax.
-
Delta THCs are Schedule I. West Virginia lists delta THCs as Schedule I controlled substances, except for products made legally under the state's hemp and medical cannabis laws.
-
Medical cannabis is separate. West Virginia's medical cannabis program is for registered patients, and adult-use marijuana isn't legal.
What Changed: West Virginia's Hemp Law Timeline
June 2023: SB 220. West Virginia began requiring permits for hemp products with THC-type cannabinoids, limited sales to adults 21 and over, added an 11% tax and set warning labels.
June 2023: SB 546. The state placed delta THCs on Schedule I, with an exception for products made legally under its hemp and medical cannabis laws.
March 2026: SB 808 didn't pass. A bill to license all consumable hemp products through the Alcohol Beverage Control Administration and ban smokable hemp died in committee.
December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
