CBD Oil in Puerto Rico: 2026 Laws and How to Buy Lab-Tested CBD
CBD is legal in Puerto Rico, and you can have it shipped to your door anywhere on the island. As a U.S. territory, Puerto Rico follows the federal definition of hemp, and its Department of Agriculture runs the local hemp program. This page explains the rules, what's changing federally in December 2026, and how to get GoGreen Hemp's lab-tested, THC-free CBD delivered from our Florida headquarters.
Is CBD Legal in Puerto Rico?
Yes. Hemp-derived CBD with 0.3% delta-9 THC or less is legal in Puerto Rico, and you don't need a medical cannabis card to buy it. A few things to know:
-
Hemp vs. medical cannabis. Hemp and CBD are overseen by the Puerto Rico Department of Agriculture. Medical cannabis is a separate program run by the Department of Health under Act 42-2017.
-
No health claims. Puerto Rico's Department of Health has said that products can't claim medical benefits unless the FDA has approved them.
-
Ship it like the mainland. Because Puerto Rico is a U.S. territory, hemp-derived CBD ships there by U.S. mail, with no customs forms.
What Changed: Puerto Rico's Hemp Law Timeline
July 9, 2017: Act 42-2017. Puerto Rico's medical cannabis law was signed, creating a regulated program for medical cannabis that's separate from hemp CBD.
February 2019: Executive Order OE-2019-006. Governor Ricardo Rosselló created a committee, led by the Secretary of Agriculture, to plan a hemp industry under the 2018 Farm Bill.
October 31, 2019: USDA approval. The U.S. Department of Agriculture approved Puerto Rico's hemp plan, and the Department of Agriculture now licenses hemp growers and processors.
December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It applies in Puerto Rico just as it does in the states. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
