CBD Oil in Alabama: What Changed in 2026 and Where to Buy
CBD is still legal in Alabama, but the way you buy it changed on January 1, 2026. A state law called HB 445 now requires adults to be 21 or older and to buy CBD in person from a state-licensed store. Online and mail-order sales to Alabama addresses are no longer allowed. This page explains what changed, when it happened, and where you can still find GoGreen Hemp in Alabama.
Is CBD Legal in Alabama?
Yes. Hemp-derived CBD oil, gummies, softgels and topicals are legal in Alabama for adults 21 and over. They must be sold by a retailer licensed by the Alabama Alcoholic Beverage Control (ABC) Board. Smokable hemp products, such as hemp flower and pre-rolls, are banned.
What Changed: Alabama's Hemp Law Timeline
May 14, 2025: HB 445 becomes law. Governor Kay Ivey signed HB 445, which created new rules for every hemp product sold in Alabama, including CBD.
July 1, 2025: Smokable hemp is banned. Selling or possessing smokable hemp products became a Class C felony. A group of hemp companies asked a court to block the law, and the judge denied the request the day before it took effect.
January 1, 2026: New rules for CBD and other consumable hemp products.
-
Licensed stores only. Only retailers licensed by the Alabama ABC Board can sell CBD oil, gummies and other consumable hemp products. Some licensed pharmacies can sell topical and sublingual CBD.
-
No online or mail-order sales. Hemp products can't be sold online, by mail order, through vending machines, or by direct delivery to Alabama consumers.
-
21 and over. Buyers must be at least 21, with a valid ID.
-
Labeling and packaging rules. Products must carry required labels and warnings and come in child-resistant packaging.
-
THC limits. Edible products are capped at 10 mg of total THC per serving and 40 mg per package.
-
A new tax. Hemp product sales carry a 10% state excise tax.
2026 and beyond: Federal changes are coming. Congress has also passed a new federal definition of hemp that counts total THC and limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
Advocacy groups in Alabama are pushing lawmakers to change HB 445, but for now the law is in full effect. We'll update this page if anything changes.
