CBD Oil in Tennessee: 2026 Law and THC-Free CBD Shipped to Your Door

Tennessee's hemp law changed on January 1, 2026, and many CBD brands stopped shipping to the state. The new law, HB 1376, regulates hemp-derived cannabinoid products, which are products containing delta-9 THC or other regulated cannabinoids such as delta-8. CBD itself isn't one of them. That's why GoGreen Hemp can ship its THC-free CBD tinctures, softgels, gummies and topicals to Tennessee. This page explains the law and what you can order.

Is CBD Legal in Tennessee?

Yes. Tennessee law specifically excludes CBD, along with CBG, CBN and several other non-intoxicating cannabinoids, from its definition of a hemp-derived cannabinoid. Hemp-derived topical products are excluded too.

A product is regulated as a hemp-derived cannabinoid product (HDCP) if it contains delta-9 THC, or more than 0.1% of a cannabinoid such as delta-8, THCv or HHC. HDCPs can only be sold in person at licensed stores to adults 21 and over.

What Changed: Tennessee's Hemp Law Timeline

2023: Public Chapter 526. Tennessee set its first rules for hemp-derived cannabinoid products, including a 21+ age limit, under the Tennessee Department of Agriculture.

May 21, 2025: HB 1376 becomes law. Governor Bill Lee signed HB 1376, which moved oversight of these products to the Tennessee Alcoholic Beverage Commission (ABC) and the Department of Revenue.

January 1, 2026: The new rules take effect. For hemp-derived cannabinoid products:

  • Licensed stores only. Suppliers, wholesalers and retailers need a license from the Tennessee ABC.

  • In person only. HDCPs must be sold face to face at a licensed store. Shipping or delivering them to consumers isn't allowed.

  • 21 and over. HDCP buyers must be at least 21 and show ID.

  • THCa banned. Hemp products that contain THCa can't be sold in Tennessee.

December 11, 2026: Federal changes are coming. Congress has also passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026.
