CBD Oil in Kentucky: 2026 Laws and How to Buy Lab-Tested CBD

CBD is legal in Kentucky, and you can have it shipped to your door. Under HB 544, signed in 2023, Kentucky regulates every hemp-derived cannabinoid product: products must be registered with the state, and THC products are limited to adults 21 and over. Non-intoxicating CBD can be sold without a retailer permit. This page explains the rules and how to get GoGreen Hemp's THC-free CBD delivered anywhere in Kentucky.

Is CBD Legal in Kentucky?

Yes. Hemp-derived CBD is legal in Kentucky, and the state's Cabinet for Health and Family Services regulates it. Kentucky sorts hemp products into two groups:

  • Non-intoxicating products, like CBD oil, have no more than 2.5 mg of THC per serving and at least 15 times more CBD (or other non-intoxicating cannabinoids) than THC. Stores don't need a special permit to sell them.

  • Adult-use products, like delta-8 and higher-THC hemp products, are sold only by permitted retailers to adults 21 and over.

Every hemp-derived cannabinoid product, including CBD, has to be registered with the state before it can be sold, and labels need child-resistant packaging and required warnings.

What Changed: Kentucky's Hemp Law Timeline

2014: SB 50. Kentucky launched its industrial hemp research program, and a separate 2014 law allowed CBD for certain patients in clinical trials.

March 23, 2023: HB 544. Governor Andy Beshear signed HB 544, which directed the Cabinet for Health and Family Services to regulate hemp-derived cannabinoid products, with product registration, testing, labeling and a 21+ limit for THC products.

January 1, 2025: Medical cannabis begins. Kentucky's medical cannabis program, created by SB 47 in 2023, took effect. It's separate from hemp CBD.

2026: Hemp tax and beverage bills fail. Lawmakers considered a hemp product tax and new rules for THC drinks, but neither passed.

December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
