CBD Oil in Mississippi: 2026 Laws and How to Buy Lab-Tested CBD

Mississippi's CBD rules are less settled than in most states. Hemp is legal to grow under state law, but in June 2025 the Attorney General issued an opinion that hemp products made to be swallowed are illegal without FDA approval, and some counties have acted on it. Lawmakers haven't passed a fix. This page explains where things stand and how to get GoGreen Hemp's lab-tested, THC-free CBD shipped to Mississippi.

Is CBD Legal in Mississippi?

It depends on the product. Hemp with 0.3% THC or less is legal to grow in Mississippi under the Mississippi Hemp Cultivation Act. But state law doesn't directly address hemp products made to be eaten or swallowed, and a 2025 Attorney General opinion treats those products as controlled substances unless the FDA has approved them:

  • Topicals, like balms, roll-ons and massage oil, weren't addressed in the opinion.

  • Ingestible CBD, like tinctures, gummies and softgels, falls in a gray area. An Attorney General opinion isn't a statute or a court ruling, and enforcement has varied from county to county.

  • Medical cannabis is a separate program for registered patients, sold at licensed dispensaries.

What Changed: Mississippi's Hemp Law Timeline

2020: The Mississippi Hemp Cultivation Act. Governor Tate Reeves signed SB 2725, which made hemp with 0.3% THC or less legal to grow under the Mississippi Department of Agriculture and Commerce.

February 2, 2022: Medical cannabis. The Mississippi Medical Cannabis Act created a medical marijuana program with licensed dispensaries.

2024–2026: Hemp bills fail. Lawmakers tried to regulate hemp products in 2024, 2025 and 2026. HB 1676 died in conference in 2024, and the 2025 and 2026 bills died before passage.

June 11, 2025: The Attorney General's opinion. Attorney General Lynn Fitch concluded that hemp products designed for human ingestion that aren't FDA-approved are controlled substances under Mississippi law. Some sheriffs, starting in Jackson County, told stores to remove those products.

December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
