Is CBD Legal in Arkansas?

Yes. Hemp-derived CBD is legal in Arkansas when the finished product contains 0.3% delta-9 THC or less. Delta-8, delta-10 and synthetic cannabinoids are not legal. Non-intoxicating CBD products like GoGreen Hemp's are unaffected by the state's ban.

What Changed: Arkansas's Hemp Law Timeline

2017: Arkansas creates its hemp program. The Arkansas Industrial Hemp Act (Act 981) set up the state's hemp program.

April 2023: Act 629 becomes law. Act 629 (SB 358) tightened the rules for hemp products:

  • Delta-8 and delta-10 banned. Delta-8, delta-10 and synthetically produced cannabinoids were added to Arkansas's list of controlled substances.

  • 0.3% THC in the finished product. The 0.3% delta-9 THC limit applies to the product you buy, not just the hemp plant.

  • CBD stays legal. Hemp-derived CBD that meets the THC limit is still allowed.

September 2023: A court pauses the law. A federal judge blocked enforcement of Act 629 while hemp businesses challenged it.

June 24, 2025: The ban returns. The Eighth Circuit Court of Appeals reversed that decision, and Arkansas began enforcing the ban on delta-8 and similar products in late August 2025.

2026 and beyond: Federal changes are coming. Congress has also passed a new federal definition of hemp that counts total THC and limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
