2019: HB 2167 and Claire and Lola's Law. Kansas created its commercial hemp program and banned smokable hemp products. Separately, SB 28 gave qualifying patients a legal defense for CBD with up to 5% THC.

2026: SB 292 dies. SB 292 would have banned hemp-derived cannabinoid sales to anyone under 21 and set new packaging and labeling rules. It died in the Senate Federal and State Affairs Committee.

December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. Kansas's THC-free rule stays stricter.
