CBD Oil in North Dakota: 2026 Laws and How to Buy Lab-Tested CBD
CBD is legal in North Dakota, and you can have it shipped to your door. North Dakota has some of the stricter hemp rules in the region: it counts THCA toward the THC limit, and it bans delta-8, other converted cannabinoids and hemp vapes. Non-intoxicating, hemp-derived CBD is still legal. This page explains the rules and how to get GoGreen Hemp's THC-free CBD delivered anywhere in North Dakota.
Is CBD Legal in North Dakota?
Yes. Hemp-derived CBD with 0.3% total THC or less is legal in North Dakota, and you don't need a medical marijuana card to buy it. A few rules to know:
-
Total THC counts. North Dakota measures THC as delta-9 THC plus converted THCA, not delta-9 alone, so some products sold as "hemp" in other states don't qualify here.
-
No delta-8 or converted cannabinoids. Delta-8, THC-O, HHC, THCP and other synthetic or chemically converted cannabinoids aren't legal hemp in North Dakota.
-
No hemp vapes. Vapes and other inhalants made from hemp extract aren't allowed.
-
Marijuana is medical only. North Dakota voters turned down adult-use marijuana in 2022 and 2024. The state's medical marijuana program is for registered patients.
What Changed: North Dakota's Hemp Law Timeline
2019: HB 1349. North Dakota adopted the federal definition of hemp and put the Department of Agriculture in charge of hemp licensing.
2021: HB 1045. The state redefined THC to include every isomer of THC, not just delta-9, and banned converting CBD into THC.
April 2023: SB 2096. Delta-8 and other chemically converted cannabinoids were removed from North Dakota's definition of hemp.
December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
