What Changed: South Dakota's Hemp Law Timeline
2020: HB 1008. South Dakota legalized industrial hemp, allowing licensed growing, processing and transport.
July 1, 2024: HB 1125. The state banned delta-8 and other chemically converted cannabinoids.
March 2026: SB 39 and SB 45. Governor Larry Rhoden signed SB 39, which repealed the state hemp program so growers are licensed by the USDA, and SB 45, which bans sales of hemp-derived THC products to anyone under 21. A broader bill, SB 61, to move intoxicating hemp products into medical cannabis dispensaries didn't become law.
December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container.
