Is CBD Legal in New Hampshire?

Yes. Hemp-derived CBD with 0.3% delta-9 THC or less is legal in New Hampshire, and you don't need a therapeutic cannabis card to buy it. A few rules to know:

  • 0.4 mg THC per container, starting January 1, 2027. Under SB 624, a finished hemp product can't have more than 0.4 mg of total THC per container, counting every form of THC.

  • Any THC means 21+. From the same date, no one under 21 can buy, have or use a hemp product that contains natural or synthetic THC in any amount.

  • Delta-8 and THCA count. The limit covers delta-8, delta-9, THCA and other forms of THC.

  • Marijuana is medical only. New Hampshire's therapeutic cannabis program is for registered patients, and adult-use marijuana isn't legal.
