CBD Oil in Virginia: 2026 Laws and How to Buy Lab-Tested CBD
CBD is legal in Virginia, and you can have it shipped to your door. Virginia's hemp rules tightened in 2026: since August 15, hemp products can have no more than 2 mg of total THC per package, and the Virginia Cannabis Control Authority now oversees hemp. THC-free CBD isn't affected by the new cap. This page explains the rules and how to get GoGreen Hemp's lab-tested, THC-free CBD delivered anywhere in Virginia.
Is CBD Legal in Virginia?
Yes. Hemp-derived CBD is legal in Virginia within the state's limits:
-
2 mg THC cap. Since August 15, 2026, a product with more than 2 mg of total THC per package isn't hemp under Virginia law and is treated as marijuana. The old exception for products with 25 times more CBD than THC is gone.
-
21+ for THC. Hemp products you eat, drink or inhale that contain THC can't be sold to anyone under 21, and their labels must say so.
-
Label rules. Labels for edible hemp products must list ingredients, serving size and THC per serving. Topicals must be labeled "not intended for human consumption."
-
Registered stores. Stores that sell hemp products you eat or inhale need a state hemp retail registration.
What Changed: Virginia's Hemp Law Timeline
July 1, 2023: SB 903. Virginia set a 21+ limit for hemp products containing THC, created retail registrations for hemp sellers, set labeling rules and limited hemp products to 2 mg of THC per package unless they had at least 25 times more CBD.
June 29, 2026: HB 30 becomes law. Virginia's adult-use cannabis law, with retail marijuana sales planned to start in 2027, also tightened the rules for hemp and moved hemp enforcement from the Virginia Department of Agriculture and Consumer Services to the Cannabis Control Authority.
August 15, 2026: The 2 mg cap takes effect. Hemp products are now capped at 2 mg of total THC per package, with no ratio exception. A federal judge declined to block the change on August 14.
December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
