CBD Oil in Maryland: 2026 Laws and How to Buy Lab-Tested CBD

CBD is legal in Maryland, and you can have it shipped to your door. Since 2023, Maryland has limited hemp products with more than a trace of THC to licensed cannabis dispensaries, and in 2025 the state stepped up enforcement and won a court fight over those limits. Non-intoxicating, hemp-derived CBD is still legal. This page explains the rules and how to get GoGreen Hemp's THC-free CBD delivered anywhere in Maryland.

Is CBD Legal in Maryland?

Yes. Hemp-derived CBD with 0.3% delta-9 THC or less is legal in Maryland, and you don't need a medical cannabis card to buy it. A few rules to know:

  • THC limits for hemp products. A hemp product meant to be eaten or inhaled can't have more than 0.5 mg of THC per serving or 2.5 mg of THC per package unless it's sold by a licensed cannabis dispensary.

  • Intoxicating hemp is dispensary-only. Delta-8, delta-10 and other THC products over those limits can only be sold in licensed dispensaries, to adults 21 and over.

  • CBD itself isn't capped. The limits count THC, not CBD, so non-intoxicating CBD products can be sold anywhere.

  • Adult-use cannabis is separate. Marijuana is legal for adults 21 and over in Maryland, but it's sold only in licensed dispensaries.

What Changed: Maryland's Hemp Law Timeline

July 1, 2023: Cannabis Reform Act. When adult-use cannabis sales began, Maryland moved hemp products over 0.5 mg of THC per serving or 2.5 mg per package into licensed dispensaries, for adults 21 and over.

July 1, 2025: SB 214. The Alcohol, Tobacco and Cannabis Commission (ATCC) gained power to cite sellers and seize over-limit THC products sold outside dispensaries.

September 2025: Court ruling. In Moore v. Maryland Hemp Coalition, a Maryland appeals court upheld the state's limits on hemp-derived THC products.

December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
