What Changed: Delaware's Hemp Law Timeline
April 2023: HB 1 and HB 2. Delaware legalized marijuana for adults 21 and over and set up its licensed marijuana market.
June 30, 2026: HB 395 stalls. A bill to treat hemp products with more than 0.4 mg of total THC per container as marijuana passed the House but didn't get a Senate vote before the session ended.
October 21, 2026: HB 373 takes effect. Governor Matt Meyer signed this law in July. It allows hemp THC drinks at liquor stores and marijuana retailers for adults 21 and over, and it ends automatically when the federal hemp change takes effect.
December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
