• No delta-8 outside licensed stores. Delta-8 and other hemp-derived or synthetic THC can't be sold by unlicensed shops.

• Topicals are treated differently. Lotions, balms and other products that aren't eaten or inhaled fall outside the detectable-THC rule.

What Changed: Washington's Hemp Law Timeline

2019: SB 5276. Washington created its state hemp program under the Department of Agriculture (WSDA).

2021: ESB 5372. The state set up registration for hemp processors with the WSDA.

July 23, 2023: SB 5367. Products with any detectable THC that are meant to be eaten, drunk or inhaled became cannabis products, sold only by licensed cannabis retailers.

December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container.
