Is CBD Legal in Alaska?

Yes, with a catch. Hemp-derived CBD is legal in Alaska only if the THC has been removed. Unlike most states, which allow up to 0.3% THC, Alaska prohibits any delta-9 THC in hemp products for human or animal consumption. That means THC-free broad-spectrum CBD and CBD isolate are allowed, while full-spectrum CBD is not.

What Changed: Alaska's Hemp Law Timeline

April 2018: Alaska legalizes industrial hemp. Governor Bill Walker signed SB 6, which created the state's industrial hemp program.

April 2020: State hemp rules take effect. Hemp growers, processors and retailers must register with the Alaska Division of Agriculture. Enforcement of retailer registration began January 1, 2021.

  • Registered sellers only. In-state and out-of-state retailers, including online stores that ship to Alaska, must register and renew every year.

  • Endorsed products only. Each hemp product must be endorsed by the Division of Agriculture before it can be sold in Alaska.

  • Testing. Products must be tested, and the certificate of analysis has to show the THC was removed.

January 31, 2025: Zero-THC advisory. The Division of Agriculture reminded sellers that Alaska prohibits delta-9 THC and non-naturally occurring cannabinoids such as delta-8, delta-10 and HHC in hemp products. Products that aren't endorsed must come off the shelves.

2026 and beyond: Federal changes are coming. Congress has also passed a new federal definition of hemp that counts total THC and limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
