CBD Oil in Hawaii: 2026 Laws and How to Buy Lab-Tested CBD

CBD is legal in Hawaii, but the rules changed on January 1, 2026. Under Act 269, every business that sells hemp products in Hawaii, including online stores on the mainland, has to register with the state. Hawaii also limits how much THC hemp products can contain and sets a 21+ age limit for CBD tinctures. This page explains the rules and how to get GoGreen Hemp's THC-free CBD shipped to any island.

Is CBD Legal in Hawaii?

Yes. Hemp-derived CBD is legal in Hawaii in approved forms, as long as it stays within the state's THC limits:

  • Allowed forms: oil-based tinctures, gummies, capsules, softgels, tablets, powders, beverages and topicals.

  • Banned: hemp flower, pre-rolls, vapes and concentrates, synthetic cannabinoids like delta-8, and foods with added cannabinoids.

  • THC limits: 0.3% total THC by weight for all products. Gummies, capsules and softgels are also capped at 1 mg THC per piece and 5 mg per container. Tinctures are capped at 3 mg per serving.

What Changed: Hawaii's Hemp Law Timeline

July 2, 2025: Act 269 becomes law. Governor Josh Green signed HB 1482 (Act 269), which created a state registry for businesses that sell hemp products.

November 4, 2025: The state prepares sellers. The Hawaii Department of Health launched outreach to help hemp businesses get ready for registration.

January 1, 2026: Registration begins.

  • Registered sellers. Retailers, distributors and online sellers, including those outside Hawaii, must register with the state to sell most hemp products.

  • Tinctures are 21+. CBD tinctures can only be sold to adults 21 and over, with ID verification.

  • Label rules. Labels need a batch number, a QR code to lab results, THC content in milligrams, and the warning "Not for sale to persons under the age of 21."

December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
