CBD Oil in California: 2026 Laws and How to Buy Lab-Tested CBD

CBD is legal in California for adults 21 and over, but the rules changed on January 1, 2026. Under AB 8, CBD you eat, drink or swallow must be made from highly purified CBD isolate with no detectable THC, and intoxicating hemp products can only be sold at licensed cannabis dispensaries. This page explains California's rules and how to get GoGreen Hemp's lab-tested CBD shipped anywhere in the state.

Is CBD Legal in California?

Yes, for adults 21 and over. The California Department of Public Health (CDPH) regulates hemp products, and the rules depend on the type of product:

  • CBD you swallow, like tinctures, gummies, softgels, drinks and pet food, must use CBD or CBN isolate that's more than 99% pure, with no detectable THC.

  • Topicals and cosmetics, like balms and lotions, can have up to 0.3% THC.

  • 21 and over. Hemp products meant for human consumption can't be sold to anyone under 21.

  • Registered makers. Companies that make hemp products sold in California, including out-of-state manufacturers, must be registered with CDPH.

  • No intoxicating hemp. Delta-8, hemp THC products and smokable hemp can't be sold in regular stores; intoxicating cannabinoids belong in licensed dispensaries.

What Changed: California's Hemp Law Timeline

October 6, 2021: AB 45. Governor Gavin Newsom signed AB 45, which allowed hemp CBD in food, drinks and dietary supplements and required hemp manufacturers, including out-of-state companies, to register with CDPH.

September 2024: Emergency rules. CDPH banned detectable THC in hemp food and drinks, limited packages to five servings, and set a 21+ age limit for hemp products. The rules were readopted in 2025.

January 1, 2026: AB 8 takes effect. Signed October 2, 2025, AB 8 made the no-detectable-THC rule law, required CBD in ingestible products to be at least 99% pure isolate, and moved intoxicating hemp products into the licensed cannabis system.

December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026.
