Is CBD Legal in Nevada?

Yes. Hemp-derived CBD with 0.3% THC or less is legal in Nevada, and you don't need a medical card or a dispensary to buy it. Nevada doesn't set a state minimum age for hemp CBD, though many stores sell only to adults. Marijuana-derived CBD is a separate product sold at licensed cannabis dispensaries to adults 21 and over.

What Changed: Nevada's Hemp Law Timeline

2017: Commercial hemp farming. SB 396 expanded Nevada's hemp research program into a commercial hemp program run by the Nevada Department of Agriculture.

2025: Lawmakers debate intoxicating hemp.

  • SB 356 failed. It would have moved intoxicating hemp products into licensed cannabis dispensaries, but it died in committee in April 2025.

  • AB 504 passed. Since October 1, 2025, unlicensed stores selling certain hemp products must post a sign saying "This location is not licensed to sell cannabis," and misleading hemp advertising is treated as a deceptive trade practice.

  • AB 76 ordered a study. The state's Cannabis Advisory Commission formed a hemp subcommittee to recommend rules.

November 9, 2026: The state hemp report. The Cannabis Advisory Commission's recommendations are due to lawmakers. The subcommittee has proposed a 21+ age limit, product registration and online sales rules for intoxicating hemp products. Nevada's next legislative session starts in 2027.

December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
