CBD Oil in Idaho: 2026 Laws and How to Buy THC-Free CBD
Idaho has some of the strictest CBD rules in the country. CBD is legal here only if it contains zero THC, so the full-spectrum products sold in most states are illegal in Idaho. A new law that took effect July 1, 2026 makes clear that stores selling hemp products must follow the state's hemp rules. This page explains what's legal and how to get GoGreen Hemp's lab-tested, THC-free CBD shipped anywhere in Idaho.
Is CBD Legal in Idaho?
Yes, but only if it has zero THC. Idaho treats any product with THC, even the trace amounts federal law allows, as marijuana. That means:
-
Legal: CBD isolate and broad-spectrum CBD that tests at 0.0% THC (shown as "ND," or non-detect, on the lab report).
-
Illegal: full-spectrum CBD with trace THC, hemp flower, and delta-8, delta-10 and other THC products.
-
Prescription only: Epidiolex, the FDA-approved CBD medicine, is legal with a prescription.
Possessing a product with THC can lead to marijuana charges, including a mandatory $300 minimum fine.
What Changed: Idaho's Hemp Law Timeline
2015: Zero-THC guidance. The Idaho Attorney General's office said CBD is allowed only if it contains 0% THC. Idaho has kept that standard since.
April 16, 2021: HB 126. Governor Brad Little signed the Industrial Hemp Research and Development Act, making Idaho the last state to allow hemp farming and transport. Consumer products still have to contain zero THC.
July 1, 2025: Tougher penalties. A new law set a mandatory $300 minimum fine for possessing marijuana, which in Idaho includes products with any THC.
July 1, 2026: H0879 takes effect. Signed April 2, 2026, this law says retailers selling hemp products meant to be eaten or inhaled must comply with the state hemp act.
December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. Idaho's zero-THC rule stays stricter.

Where to Buy CBD in Idaho
Prefer to shop in person? Idaho officials say mislabeled CBD is common, so check the lab report before you buy. It should show THC as "ND" or 0.0%, not just "under 0.3%." If you own a shop, become a GoGreen Hemp wholesale partner and we'll list your store here.
