What Changed: New Mexico's Hemp Law Timeline

April 2, 2019: The Hemp Manufacturing Act. Governor Michelle Lujan Grisham signed HB 581, which set up state rules for producing, testing, manufacturing and transporting hemp and hemp products, including CBD.

August 2025: Emergency hemp rule. The New Mexico Environment Department (NMED) issued an emergency rule banning hemp products made with chemically converted or synthesized cannabinoids, such as delta-8, delta-10, THC-O and HHC.

January 28, 2026: Permanent hemp rule. NMED made the emergency rule permanent (20.10.2 NMAC) and added:

  • THC limits. Total THC in finished hemp products is limited per serving.

  • Testing. New pesticide-testing requirements for hemp products.

  • Label warnings. New warning statements on hemp product labels, with QR codes allowed.

  • CBD stays legal. Non-intoxicating CBD products that meet the rules can still be sold.

December 11, 2026: Federal changes are coming. Congress has passed a new federal definition of hemp that limits finished products to 0.4 mg of total THC per container. It was set to take effect on November 12, 2026, and has since been pushed back to December 11, 2026. GoGreen Hemp's broad-spectrum products are made to contain 0.0% THC.
